<p>The <strong>War on Terror</strong>, started by the US government as a response to the September 11, 2001 terror attacks and later joined by other governments, has had and continues to have <strong>grave consequences</strong> for the <strong>human rights</strong> of their citizens and of citizens of other countries. This is a high price for an uncertain gain.</p>
<p>However, before I list these consequences, I would like to make it clear that I believe, as any rational human being, that terrorism is <strong>evil</strong>, that it has to be destroyed and that democracies have a right to defend themselves against violent, anti-democratic fanatics (see <a href="http://filipspagnoli.wordpress.com/2008/04/06/human-rights-quote-22/">this post</a>).</p>
<p>I also believe that democratic governments should be especially vigilant because the freedoms that they are elected to protect, offer <strong>opportunities</strong> for those who hate freedom, opportunities that do not exist in other political systems. Potential terrorists find it relatively easy to enter a democracy and operate in it. A democracy is a very vulnerable form of government because of the freedom it gives to everyone, even those who don't mean well.</p>

<p>The freedoms of a democracy can be and are abused, but this, it seems, has frightened democratic governments to such an extent that they have decided to <strong>limit these freedoms</strong> up to the point that they are in danger of abandoning their values, and hence doing the work of the terrorists for them. It can be acceptable to <a href="http://filipspagnoli.wordpress.com/2008/07/22/limiting-free-speech-1-introduction/">limit certain rights for the protection of other rights</a> (see also <a href="http://filipspagnoli.wordpress.com/2008/05/28/human-rights-facts-23-state-of-emergency/">this post</a>), but the right to <strong>security</strong> has taken on an absolute priority, at the expense of all other rights. There is no reasonable balance anymore. Some have called the war on terror a "war on freedom" (<a href="http://www.globalissues.org/Geopolitics/WarOnTerror.asp">source</a>).</p>
<p><strong>1. Civil liberties</strong></p>
<p>Governments try to defend their countries against terrorist attacks by limiting civil liberties in their territories.</p>
<ul>
<li>The right to <strong>privacy</strong> has been limited: CCTV has become ubiquitous, DNA databases have been created, <a href="http://filipspagnoli.wordpress.com/2008/04/03/human-rights-cartoon-4/">eavesdropping and wiretapping</a> have been legalized etc.</li>
<li>"No-fly-lists" have come into force, limiting the freedom of <strong>movement</strong> of even those who have written critically of the government or attended peace-protests.</li>
<li><a href="http://filipspagnoli.wordpress.com/2008/07/23/limiting-free-speech-3-hate-speech/">Hate speech laws</a> have been voted to silence jihadist hate preachers, <strong>silencing</strong> others at the same time.</li>
<li>"Racial profiling" by the police has turned innocent people into possible suspects, often inversing the burden of proof.</li>
<li><a href="http://filipspagnoli.wordpress.com/2008/05/17/human-rights-cartoon-83/">Habeas corpus</a> has been limited, periods of <strong>detention</strong> without charge extended, sometimes indefinitely (for "enemy combatants").</li>
</ul>
<p>However, in spite of all this, the constraints on a government's actions within its territory are sometimes still considered to be inhibiting:</p>
<ul>
<li>"Extraordinary rendition" has been covertly practiced, allowing suspects to be <strong>tortured</strong> outside of the territory by professional torturers in other countries.</li>
<li>Extra-territorial prisons have been created, in <a href="http://filipspagnoli.wordpress.com/2008/06/13/human-rights-quote-56-habeas-corpus-and-guantanamo/">Guantanamo</a>, but probably elsewhere as well, where suspects can be <a href="http://filipspagnoli.wordpress.com/2008/07/10/human-rights-cartoon-95-waterboarding/">tortured</a> or held indefinitely and where the Geneva Conventions supposedly don't apply.</li>
</ul>

<p><strong>2. Mentalities</strong></p>
<p>The war on terror has also changed people’s minds and attitudes.</p>
<ul>
<li>The media have started to <strong>censor themselves</strong>. Solidarity with the government at war and the commander-in-chief, or the fear of being perceived as unpatriotic, appeasers, "useful idiots" or even open allies of the enemy has turned them into uncritical supporters of the war.</li>
<li>Citizens have turned on Islam and Muslims. <a href="http://filipspagnoli.wordpress.com/2008/06/30/human-rights-facts-41-xenophobia/">Xenophobia</a> and more specifically islamophobia have undermined the ideals of <a href="http://filipspagnoli.wordpress.com/2008/04/03/tolerance/">tolerance</a> and multiculturalism, and have in certain cases even led to <a href="http://filipspagnoli.wordpress.com/2008/07/15/human-rights-quote-79-hate-crime/">hate crimes</a> against Muslims.</li>
<li>A "culture of fear" has been created by the terrorist but also nurtured by irresponsible western politicians. This <strong>fear</strong> has damaged democracy. Not only have the media relinquished their traditional role as watchdogs. Politicians as well, and especially incumbents, have abused the fear of terrorism to harness support. Alert levels seem to go up just before elections.</li>
</ul>
<p><strong>3. Preemptive war</strong></p>
<p>The US government has elaborated and implemented the strategy of preemptive war, a war</p>
<blockquote><p>waged in an attempt to repel or defeat a perceived inevitable offensive or invasion, or to gain a strategic advantage in an impending (allegedly unavoidable) war. (<a href="http://en.wikipedia.org/wiki/Preemptive_war">source</a>)</p></blockquote>
<p>The <strong>Iraq war</strong> was deemed a preemptive war because Iraq was allegedly about to attack the US with weapons of mass destruction, or supply these weapons to terrorists. Whatever the merits of the case against Iraq – and with the passing of time these seem to become weaker and weaker - the war has been framed, correctly or not, as a necessary stage in the ongoing war on terror. It has, however, resulted in massive numbers of <strong>casualties</strong> on both sides. The human rights violations caused by the war stand in no relation to the violations caused by terrorism or the violations that could have been caused by Saddam.</p>
<p>In any case, you can't solve the problem of terrorism by violent means only. Terrorism has causes, and there will be terrorism as long as these causes exist. (Mind you, I don't want to excuse or justify terrorism).</p>

<p><strong>4. Counter-productive</strong></p>
<p>It is now widely believed, even in US government circles, that the war on terror is counter-productive. Especially the wars in Iraq and Afghanistan, the torture in Abu Ghraib and the detentions in Guantanamo have produced a backlash and have <strong>increased rather than reduced</strong> the terror threat. The 2007 National Intelligence Estimate issued the following among its "key judgments":</p>
<blockquote><p>The Iraq conflict has become the "cause celebre" for jihadists, breeding a deep resentment of US involvement in the Muslim world and cultivating supporters for the global jihadist movement. (<a href="http://en.wikipedia.org/wiki/War_on_Terror">source</a>)</p></blockquote>
<p>The war on terror has created and exacerbated resentment, hatred of the West and anti-americanism. And with anti-americanism often comes hatred of democracy and freedom and Islamic radicalization. Apart from the removal of the Taliban in Afghanistan, there is no evidence that any of the strategies in the war on terror has done any good (<a href="http://www.washingtonpost.com/wp-dyn/content/article/2007/03/23/AR2007032301613.html">source</a>).</p>
<p><strong>5. Misnomer</strong></p>
<p>There is something fishy about the concept of a "war on terrorism". This "war" is in fact no such thing. It is in essence <strong>crime prevention</strong> and law enforcement. There is no well-defined enemy. Anyone can at any time become an enemy. For this reason, there is no conceivable end to the war. And if you claim to wage a war on terrorism, you might as well claim to wage a war on carpet bombing. Both are tactics or strategies, not something you wage war against.</p>
<p>If you insist on calling anti-terrorist actions a war, then you give too much credit to the riffraff you're opposing. Rather than deranged criminals they can call themselves soldiers. And soldiers defend something. You <strong>legitimize</strong> them. You turn a crime into a two-sided struggle in which each side defends its positions. This in turn leads to the view that the war on terror is a war of the West against the rest, bringing back images of colonialism, imperialism and the crusades, again legitimizing the terrorists, helping to consolidate their often internally opposed forces, and making them honorable in the eyes of ordinary citizens outside of the West.</p>

<p>I can understand that the concept of a "war on terrorism" is useful for the executives in the West, because an executive that is at war has more powers, less oversight, more popular support and less criticism, but it's a meaningless and dangerous concept. Let's give it up.</p>

Confirma-se a suspeita de que os tribunais servem aos ricos e está a serviço de uma certa justiça com dois pesos e duas medidas.</span></p>

<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">Desta vez, a decisão favorável a redução de pena dada a Pimenta Neves, assassino confesso da morte de Sandra Gomide, em agosto de 2000, corrobora ainda mais com a suspeita. A ministra Maria Thereza de Assis de Moura, negou pedido de anulação do júri , mas reduziu em três anos a pena do assassino. Todas as justificativas da ministra são injustificáveis.</span></p>

<p style="text-align:left;" dir="ltr">
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">Nenhum Estado moderno pode ser considerado democrático e civilizado se não tiver um Poder Judiciário independente e imparcial, que tome por parâmetro máximo a Constituição e que tenha condições efetivas para impedir arbitrariedades e corrupção, assegurando, desse modo, os direitos consagrados nos dispositivos constitucionais.</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">Sem o respeito aos direitos e aos órgãos e instituições encarregados de protegê-los, o que resta é a lei do mais forte, do mais atrevido, do mais astucioso, do mais oportunista, do mais demagogo, do mais distanciado da ética.</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">Essas considerações, que apenas reproduzem e sintetizam o que tem sido afirmado e reafirmado por todos os teóricos do Estado democrático de Direito, são necessárias e oportunas em face da notícia de que o presidente da República, com afoiteza e imprudência muito estranhas, encaminhou ao Senado uma indicação para membro do Supremo Tribunal Federal, que pode ser considerada verdadeira declaração de guerra do Poder Executivo federal ao Poder Judiciário, ao Ministério Público, à Ordem dos Advogados do Brasil e a toda a comunidade jurídica.</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">Se essa indicação vier a ser aprovada pelo Senado, não há exagero em afirmar que estarão correndo sério risco a proteção dos direitos no Brasil, o combate à corrupção e a própria normalidade constitucional. Por isso é necessário chamar a atenção para alguns fatos graves, a fim de que o povo e a imprensa fiquem vigilantes e exijam das autoridades o cumprimento rigoroso e honesto de suas atribuições constitucionais, com a firmeza e transparência indispensáveis num sistema democrático.</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">Segundo vem sendo divulgado por vários órgãos da imprensa, estaria sendo montada uma grande operação para anular o Supremo Tribunal Federal, tornando-o completamente submisso ao atual chefe do Executivo, mesmo depois do término de seu mandato. Um sinal dessa investida seria a indicação, agora concretizada, do atual advogado-geral da União, Gilmar Mendes, alto funcionário subordinado ao presidente da República, para a próxima vaga na Suprema Corte. Além da estranha afoiteza do presidente -pois a indicação foi noticiada antes que se formalizasse a abertura da vaga-, o nome indicado está longe de preencher os requisitos necessários para que alguém seja membro da mais alta corte do país.</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">É oportuno lembrar que o STF dá a última palavra sobre a constitucionalidade das leis e dos atos das autoridades públicas e terá papel fundamental na promoção da responsabilidade do presidente da República pela prática de ilegalidades e corrupção.</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">É importante assinalar que aquele alto funcionário do Executivo especializou-se em "inventar" soluções jurídicas no interesse do governo. Ele foi assessor muito próximo do ex-presidente Collor, que nunca se notabilizou pelo respeito ao direito. Já no governo Fernando Henrique, o mesmo dr. Gilmar Mendes, que pertence ao Ministério Público da União, aparece assessorando o ministro da Justiça Nelson Jobim, na tentativa de anular a demarcação de áreas indígenas. Alegando inconstitucionalidade, duas vezes negada pelo STF, "inventaram" uma tese jurídica, que serviu de base para um decreto do presidente Fernando Henrique revogando o decreto em que se baseavam as demarcações. Mais recentemente, o advogado-geral da União, derrotado no Judiciário em outro caso, recomendou aos órgãos da administração que não cumprissem decisões judiciais.</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">Medidas desse tipo, propostas e adotadas por sugestão do advogado-geral da União, muitas vezes eram claramente inconstitucionais e deram fundamento para a concessão de liminares e decisões de juízes e tribunais, contra atos de autoridades federais.</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">Indignado com essas derrotas judiciais, o dr. Gilmar Mendes fez inúmeros pronunciamentos pela imprensa, agredindo grosseiramente juízes e tribunais, o que culminou com sua afirmação textual de que o sistema judiciário brasileiro é um "manicômio judiciário".</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">Obviamente isso ofendeu gravemente a todos os juízes brasileiros ciosos de sua dignidade, o que ficou claramente expresso em artigo publicado no "Informe", veículo de divulgação do Tribunal Regional Federal da 1ª Região (edição 107, dezembro de 2001). Num texto sereno e objetivo, significativamente intitulado "Manicômio Judiciário" e assinado pelo presidente daquele tribunal, observa-se que "não são decisões injustas que causam a irritação, a iracúndia, a irritabilidade do advogado-geral da União, mas as decisões contrárias às medidas do Poder Executivo".</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">E não faltaram injúrias aos advogados, pois, na opinião do dr. Gilmar Mendes, toda liminar concedida contra ato do governo federal é produto de conluio corrupto entre advogados e juízes, sócios na "indústria de liminares".</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">A par desse desrespeito pelas instituições jurídicas, existe mais um problema ético. Revelou a revista "Época" (22/4/ 02, pág. 40) que a chefia da Advocacia Geral da União, isso é, o dr. Gilmar Mendes, pagou R$ 32.400 ao Instituto Brasiliense de Direito Público -do qual o mesmo dr. Gilmar Mendes é um dos proprietários- para que seus subordinados lá fizessem cursos. Isso é contrário à ética e à probidade administrativa, estando muito longe de se enquadrar na "reputação ilibada", exigida pelo artigo 101 da Constituição, para que alguém integre o Supremo.</span></p>
<p style="text-align:left;" dir="ltr"><span style="font-size:10pt;">A comunidade jurídica sabe quem é o indicado e não pode assistir calada e submissa à consumação dessa escolha notoriamente inadequada, contribuindo, com sua omissão, para que a arguição pública do candidato pelo Senado, prevista no artigo 52 da Constituição, seja apenas uma simulação ou "ação entre amigos". É assim que se degradam as instituições e se corrompem os fundamentos da ordem constitucional democrática.</span></p>

<p>Hey everybody, lookit what I just found:</p>
<p>It appears that some Political Science professor named Marc Turetzky, of Gavilan College (in Gilroy, California, home of the always fragrant Gilroy Garlic Festival) has set up one of those "Rate My ______" sites.</p>
<p>There are a whole mess of these things. Rate My Picture. Rate My Life. Rate My Date. Rate My Rack. The one I'm most familiar with is RateMyProfessors.com, because hey, grad student here. This one is new, though:</p>
<p>It's time to play <a href="http://ratemycongressman.wordpress.com/">Rate My Congressman</a>!</p>
<p>It's set up in blog format, one blog post per Representative. Visitors to the site are invited to rate their Representative in the Comments.</p>
<p>At least, that's what I assume we're supposed to do. It looks like the professor has been setting it up this weekend. He seems to be going state-by-state, with each state being it's own blog category. As I type this, only about twenty states are up. But hey, lookee here...it appears that he's already added all the California representatives.</p>

<p>When Nancy Pelosi rose to the position of Speaker of the House after the 2006 elections, a lot of people, myself included, thought that we would finally see an end to the Bush administration's illegal and unconstitutional actions at home and abroad.</p>
<p>Surely, with the Democrats now controlling the House of Representatives, we would see some real oversight, some investigation into the many, many scandals that seem to have become business as usual over the past few years.</p>
<p>Surely, Ms. Pelosi would use the powers granted to her by the Constitution and laws of this country to at the very least ensure that no further damage was done to our civil rights, our dignity, and our reputation among other nations.</p>
<p>Surely, she would guide the House of Representatives along a course that would rein in the worst abuses of the Bush administration.</p>
<p>Surely, you jest.</p>
<p>Almost immediately, she made it clear that impeachment - the most powerful tool granted to Congress to control illegal acts by the executive branch - was off the table.</p>
<p>The reason for doing so has never been clear to me. If ever there were a president deserving of impeachment, it would be the current Decider in Chief. His crimes against our constitution, against our laws, and against humanity are almost too numerous to itemize at this point. Failure to impeach such a man under these circumstances would itself be a failure by Congress to uphold its responsibilities under the constitution.</p>
<p>And yet, the president has not been impeached, despite efforts by Kucinich and others, despite widespread public outcry.</p>
<p>Because Speaker Pelosi declared that impeachment was off the table.</p>
<p>Furthermore, she has repeatedly caved in to Bush's craven demands for yet more power, yet more authority, and has allowed yet more money to be poured into the pockets of corporations like Halliburton, KBR, and Blackwater as part of his unending war on Iraq.</p>
<p>The Democrats have a strong majority in the House of Representatives. It is not like the Senate, where they can only be said to control the chamber because Lieberman is still caucusing with them.</p>
<p>It should have been relatively simple to prevent Bush from shoving through measures that were antithetical to our nation's governing documents. Measures like the revised FISA bill that passed recently.</p>
<p>What was it Nancy Reagan always used to say? Just say, "No."</p>
<p>And yet somehow, Pelosi did nothing, or next to nothing. And we are now faced with an even graver situation, both domestically and internationally, than we were in 2006.</p>
<p>And while we are rating Speaker Pelosi's performance, let us not forget that recent weeks have brought the revelation that Speaker Pelosi was among the Democratic House leaders who were briefed on the "enhanced interrogation techniques" that have been used by Americans against others in recent years. She knew we were torturing prisoners as a matter of federal government policy, yet she did and said nothing.</p>
<p>To be fair to Speaker Pelosi, she has managed some good things during her tenure as House Speaker. There have been times when she and her colleagues have stood together to pass important legislation opposed by the president, or to block legislation he tried to force through.</p>
<p>But many of those victories seem to have been only temporary ones. The House initially held strong against the FISA expansion and telecom immunity provisions, for instance, yet when faced with repeated demands from the Bush administration, the Democrats eventually caved.</p>
<p>Is it fair to blame Pelosi for that? Maybe not. But I can't help thinking that Tip O'Neill wouldn't have let some of that crap through.</p>
<p>Looking around the site here, I cannot find any rating metric for rating our representatives, so I guess it is up to me as the first commenter to propose one...</p>
<p>Hmmm...this is actually trickier than it sounds. I have several ideas, actually, but the WordPress restrictions on HTML don't seem to allow for inserting little icons in one's post, which rules out a couple of my ideas. For instance, I was going to go with little pink pigs, because, well, our representatives in Washington are feeding at the public trough, and also there's the nice Orwellian tie-in with Animal Farm.</p>
<p>But that's probably overly cynical, isn't it? After all, I'm sure there are people who want to say nice things about their representatives. I mean, not me, because I'm in Redstatesville, and my representative is a rubberstamper who votes however Bush wants him to. But surely there must be SOME people who actually like their representatives, no matter how low the approval ratings are for Congress these days, right?</p>
<p>How about this: we can use the symbol for dollars ($) as the rating icon. It's perfect, because it can carry so many meanings -- the tax dollars that they waste (or occasionally use wisely), the campaign contributions they receive from the lobbyists and heads of major corporations, the federal dollars they are able to direct to their home districts via earmarks, the bribes they receive...the possibilities are endless.</p>
<p>So, using a one ($) to five ($$$$$) scale, with five representing the best one could possibly hope for in a congressional representative and one representing pond scum:</p>
<p>My overall rating for Nancy Pelosi is: $$</p>
<p>Though to be fair, I would have given her two and one half dollar signs, if I could just figure out how to get half a dollar sign to appear.</p>

<p align="left"><strong>August 1, 2008  Wise County, Texas - </strong>Recently I read a new book published in July 2008 that documents surprising links between Adolph Hitler’s Nazi Third Reich (1933 to 1945 empire) in Germany - and America’s banks, business owners, political power-brokers and wars - past and present.</p>
<p>The new book is entitled, <em>The Rise of the Fourth Reich</em> by <em>New York Times</em> best-selling author, Jim Marrs. Jim has been tracking down facts and trying to make sense of American political history since his college days as a journalism major at the University of North Texas in Denton. He graduated in 1966 and began a newspaper reporting and editing career at the <em>Denton Record Chronicle</em>, the <em>Lubbock Avalanche Journal </em>and the <em>Fortworth-Star Telegram</em> where he was an investigative reporter, cartoonist, and earned photography awards.</p>
<p>By 1988, Jim Marrs decided that he had to put his big file about President John F. Kennedy's assassination into a book he called <em>Crossfire: The Plot That Killed Kennedy. </em>Two months after its release in 1989, Jim received a call from Hollywood film director, Oliver Stone, who wanted to option <em>Crossfire</em> for the movie that became <em>JFK.</em></p>
<p>Jim began asking book editors what they thought was the next big, secret government cover-up beyond the JFK assassination. Everyone said  “UFOs.” That's what lead Jim to write his 1997 book, <em>Alien Agenda</em>, which has become the top selling non-fiction UFO book in the world. Next was <em>Rule By Secrecy</em>, in 2000, which links the money-power elite of America with the money-power elite of Europe back to the money-power elite of Mesopotamia – which is modern day Iran and Iraq! According to Sumerian cuneiform tablets, Mesopotamia was controlled and manipulated by non-humans called Annunaki that had their own agendas on this planet.</p>
<p>After American buildings, planes and lives were destroyed on September 11, 2001, Jim did his own research and became convinced there were other truths beyond the official government version and wrote <em>The Terror Conspiracy </em>published in 2006, followed in 2007 by <em>Psi Spies: The True Story of America's Psychic Warfare Program</em>.</p>
<p>Now in his newest book, <em>The Rise of the Fourth Reich,</em> Jim Marrs lays out in great detail with names, places and dates his assertion that Hitler’s National Socialism (NAZI) did not die at the end of World War II because protégés of Hitler had spread corporate front companies around the world. Further, the United States imported Hitler’s best rocket scientists in Project Paperclip to test V-2 rockets at the White Sands Proving Ground in New Mexico.</p>
<p>Even current President George W. Bush’s grandfather  - Prescott Bush – was intimately connected in the 1930s to 1940s with the powers that represented the Rockefellers and Rothschild banking and business interests that were also involved in the creation and growth of Hitler and his Nazi Party. In late 1942, the U. S. government actually prosecuted Prescott Bush under the Trading With The Enemy Act because he was handling money for German steel magnate, Fritz Thyssen, who was helping to finance the rise of Adolph Hitler and the Nazi Third Reich.</p>

<p><strong>Jim Marrs, Journalist and Author, Wise County, Texas:</strong> “Today, almost every thinking person agrees that the United States is off on the wrong path. Some how, we’ve gotten off on the wrong foot. We’ve taken the wrong turn. We’re into dangerous waters and waters that, in many ways, are contrary to the liberties and freedom that this country was built on. The problem is that no one knows whom to identify. Liberals blame the conservatives. Conservatives blame the liberals. Republicans blame Democrats. Democrats blame Republicans.</p>
<p>Well, what I’ve done in my new book, <em>The Rise of the Fourth Reich</em>, is to document and show that we can all agree to point the finger at the one group that it’s still politically correct to vilify and that is Nazis.</p>
<p>But you have to understand that a Nazi is not necessarily a jack-booted, Swastika-bearing German. The term ‘Nazi’ is an acronym for National Socialism. That is the political system Adolph Hitler put into power in Germany in the 1930s. Even though the Germans were defeated in WWII, Nazism, or National Socialism, never was defeated. In fact, it was embraced by the ruling, wealthy, elite that runs the United States of America. These people supported Hitler in his rise to power. They supported Hitler through WWII and continued to support National Socialism long after Hitler passed from the scene.</p>
<p>The ruling elite did this in connivance with many wealthy Americans who saw profit and power and control in this system and they have slowly turned the once-free United States Republic into a new empire of the wealthy – a Fourth Reich.</p>
<p>WHAT IN JULY 2008 ARE THE BIGGEST SIMILARITIES BETWEEN ADOLPH HITLER’S THIRD REICH OF WWII AND MODERN AMERICA AND THIS WORLD?</p>
<p>We see the erosion of individual liberties. If you say anything that’s unpopular, you even risk jail and a fine. We also see increasingly that our police forces are no longer the citizen warriors or blue-clad police from a few years ago. They are now black-clad with the cold scuttle helmet, the same design that the Nazi troops used in WWII.</p>
<p>And we also see that Hitler, when he invaded Poland, he didn’t want to upset the German people by calling up general conscription (drafting youth into war), so he used reserve troops to start WWII, just like we’re using our reserve troops to fight imperial wars in Afghanistan and Iraq. Of course, then you come up through the similarities and parallels between the burning of the Reichstag and Enabling Act with the 9/11 attacks on the World Trade Center in the United States and the rapid passage of the Patriot Act and the creation of Homeland Security. The parallels between WWII Germany and modern America are all there.</p>
<p>The big difference in modern America with Nazi Germany is that in the Germany of the 1930s, the state gained control over the corporations. Today in modern America, we see that the corporations have gained control over the state. But the end result is the same.</p>
<p><span style="font-size:x-small;">America Without Habeas Corpus</span></p>
<p>UNDER THIS CURRRENT ADMINISTRATION, WE STILL DON’T EVEN HAVE A RESTORATION OF HABEAS CORPUS, WHICH MEANS ANY AMERICAN CITIZEN CAN BE ARRESTED WITHOUT CHARGE STATED.</p>
<p>That’s right. That’s why we no longer have a Republic. Without habeas corpus in the United States today, what we now have is a Fourth Reich, somebody in a position of power - the President, the Attorney General, the head of Homeland Security – can simply point a figure at you and designate you as an undesirable and hence, an enemy combatant, and they can grab you and imprison you and you don’t even get a day in court, much less a lawyer. This administration has systematically stripped the United States of its fundamental Constitutional rights. That’s bad enough, but what really concerns me is that so many people refuse to look at that. They do not want to admit that. They do not want to see it and so they are allowing it to take place and continue.</p>

On June 12, 2008, the Supreme Court ruling in Boumediene v. Bush recognized habeas corpus rights for the Guantanamo prisoners. However, the following month, the 4th Circuit Court gave the President the power to arrest and detain U.S. citizens on native soil indefinitely.]</p></blockquote>

During Prescott Bush's  tenure as Director of Hamburg America Line, the company came under investigation in the U.S. for Nazi propaganda activities linked to German steel magnate, Fritz Thyssen.</p>
<p>Business links with Fritz Thyssen:  Harriman Bank was the main Wall Street partner for several German companies and the varied U.S. financial interests of Fritz Thyssen. Thyssen had been an early financial backer of the Nazi  party, but later denounced Hitler and fled Germany. He was later jailed by the Nazis for his opposition to the Nazi regime.</p>
<p>Business transactions with Germany were not illegal until Hitler declared war on the United States on December 11, 1941. Six days after the attack on Pearl Harbor, President Franklin Delano Roosevelt signed the Trading With the Enemy Act after it had been made public that U.S. companies were doing business with the declared enemy of the United States. On October 20, 1942, the U.S. government ordered the seizure of German banking operations in New York City and seized property under the Trading with the Enemy Act. The order cited only the Union Banking Corporation (UBC), of which Prescott Bush was a director.]</p></blockquote>

<p>Right. Well, what you’ll find out in my new book, <em>The Rise of the Fourth Reich</em>, is that Osama Bin Laden was recruited into the Muslim Brotherhood back in the 1970s. The Muslim Brotherhood was created in Egypt back in the 1930s, but by the late 1930s had been pretty well taken over by a Nazi organization. A leader of the Muslim Brotherhood was a great admirer of Hitler.</p>
<p>ISN’T IT TRUE THAT ALLEN DULLES, THEN DIRECTOR OF THE CENTRAL INTELLIGENCE AGENCY IN THE 1950S, ARRANGED TO HAVE THE NAZIS OF THE MUSLIM BROTHERHOOD TRANSFERRED TO SAUDI ARABIA?</p>

assassination of President John F. Kennedy. Between active government service,<br />
Dulles was a corporate lawyer and partner at Sullivan &#38; Cromwell.</span> <span>His brother,<br />
John Foster Dulles (February 25, 1888 – May 24, 1959) served as U.S. Secretary<br />
of State under President Dwight D. Eisenhower from 1953 to 1959.</span></p>
<p>That’s correct. During the war, any serviceman who served in North Africa would probably believe that we had as much problems with the Arabs there as we had with the Nazis because the Arabs, through the Muslim Brotherhood, had aligned themselves with the Nazis.</p>
<p>But we managed to overcome that and we defeated the Nazis in WWII, so the Muslim Brotherhood was then picked up by British intelligence at the end of the war. But then a short time later, they were passed along to our CIA, which at that time was headed by Allen Dulles. His brother, John Foster Dulles, was Secretary of State under Eisenhower. The two Dulles brothers were the attorneys for Cromwell and Sullivan, which was the law firm that represented the Schroder Bank and the Rockefeller-Schroeder Investment Corporation - the very nexus of business connections that supported the Nazis.</p>
<p>So, they were instrumental in bringing Nazis over to the United States under Project Paperclip (V-2 rockets at White Sands Proving Ground, New Mexico) and other programs at the end of the war and white-washing their Nazi records. This is what put a huge nucleus of National Socialists right into our military-industrial complex where it spread out and is trying to gain control today.</p>
<p><span style="font-size:x-small;">America's CIA Trained Saudi Muslim<br />
Brotherhood in Afghanistan </span></p>
<p>ISN’T IT TRUE THAT BY 1979, THE CENTRAL INTELLIGENCE AGENCY TOOK THE NAZI SAUDI MUSLIM BROTHERHOOD TO AFGHANISTAN TO FIGHT WITH THE SOVIETS AND THEY BECAME THE MUJAHIDEEN, WHICH IN THE MODERN WORLD TODAY ARE ONE AND THE SAME AS AL QAEDA? [ <span style="text-decoration:underline;">Editor's Note: </span> The Mujahideen are Muslims involved in a jihad, fighting a war or involved in a struggle.]</p>
<p>That’s absolutely correct. When we took the Muslim Brotherhood into Afghanistan in the 1980s to fight against the Russian incursion there, the Muslim Brotherhood had already obtained a pretty bad name. They were originally thrown out of Egypt by Gamal Nasser because of their violence, but they were predominantly extremist Wahhabi Muslims. As a result, they were taken in by Saudi Arabia. This is still the predominant faction in Saudi Arabia today and, of course, this is where Osama Bin Laden entered the picture. [ <span style="text-decoration:underline;">Editor's Note:</span> Gamal Abdel Nasser (January 15, 1918 to September 28, 1970) was President of Egypt from 1956 until his death.]</p>
<p>Then after the Soviets left Afghanistan during the Clinton years when we had the was in Kosovo, we find that it was the Al Qaeda that was funding and training the Kosovo Liberation Army, which was the faction that the United States supported. So, we can see that the CIA was involved with, if not controlling, Al Qaeda all the way up until the George Bush II administration.  I think that should cause every thinking person to take a very serious second look at the attacks of 9/11.</p>
<p>WHY DO YOU THINK THAT THE CURRENT BUSH AND FORMER BUSH ACTUALLY WENT INTO IRAQ?</p>
<p>(laughs) Well, of course, there is the question of the oil. But I don’t think that is the real reason because we were getting only 16% of our imported oil from Iraq prior to our invasion and we aren’t even getting that now because they keep blowing up the pipelines. That’s also the sticking point even with our little puppet government that we put in power over there is they are dragging their feet on the relinquishing the rights to all their oil to us. They have pretty much gone along with everything else, but they still don’t want to give up all their oil rights. So, I don’t think it was about oil.</p>
<p><span style="font-size:x-small;">What Did Bush Administration Want<br />
from Iraq National Museum in Baghdad? </span></p>
<p>Personally, I think it had more to do with the looting of the Iraqi National Museum because I have in my files news articles from the associated press and European media from 1999 through 2001, speaking of ‘amazing new discoveries being made in Iraq by French and German archaeological teams, which I find very fascinating because after all it was probably France and Germany that were most opposed to our invasion of Iraq.</p>
<p>When we decided to attack Iraq in the spring of 2003, we violated normal military tactics, which is to seize an objective, consolidate your winnings and then move on to the next objective. We simply made a beeline for Baghdad, which is one of the reasons we’re having so many problems still is because we failed to pacify the countryside. Instead, we went straight to Baghdad and despite assurances to world museum directors by the Pentagon that the Iraqi National Museum would be protected, it was not and there was wholesale looting. According to Col. Matthew Bogdanos, who investigated the Iraqi Museum looting for General Tommy Franks, he described the looting of the basement as an ‘inside job.’ He said there were guards conveniently missing; they had keys to some of the locked vaults; they knew exactly what they were looking for; they by-passed expensive looking fakes. They went right for the new, uncatalogued stuff.</p>

O ministro Paulo Gallotti pediu vista do processo, mas não há data prevista para a retomada do julgamento (HC 76686).</p>

<p>. Ela aguarda a decisão sobre o mérito dos HCs que o Supremo Presidente concedeu a Dantas. </p>
<p>. E isso é responsabilidade, no primeiro round, do Ministro Eros Grau. </p>
<p>. A depender da decisão de Grau, a Procuradora – com colegas de Ministério Público – vai ou não pedir o impeachment. </p>

No caso concreto, o impetrante/paciente foi denunciado, mediante prévia representação, pela suposta prática dos delitos tipificados nos arts. 138 (calúnia contra funcionário público), 141, II e 145, todos do Código Penal. 2. Impetração em face de decisão monocrática proferida por Ministro-Relator do Superior Tribunal de Justiça que não conheceu do pedido formulado. 3. No mérito, verifica-se que a decisão impugnada negou seguimento ao pedido formulado perante o STJ por configuração de hipótese de patente incompetência nos termos do art. 105, I, "a" e "c", da CF e, ademais, nomeou a Defensoria Pública da União para o patrocínio dos interesses do impetrante/paciente. 4. Não tendo sido a questão objeto de exame definitivo pelo STJ, a apreciação da matéria pelo Supremo Tribunal Federal implicaria, ao menos em tese, supressão de instância, o que não seria admitido consoante a reiterada jurisprudência desta Corte. <p><b>Ementa <br />EMENTA: Recurso Ordinário em Habeas corpus. 1. No caso concreto, os pacientes foram condenados pela prática dos crimes previstos nos arts. 308, § 1º (corrupção passiva com pena aumentada de um terço, se, em conseqüência da vantagem ou promessa, o agente retarda ou deixa de praticar qualquer ato de ofício ou o pratica infringindo dever funcional), c/c 80 (crime continuado) e 53 (co-autoria - concurso de agentes), por duas vezes; e 243, alínea a (extorsão simples), § 1º (extorsão qualificada), c/c 53 (co-autoria - concurso de agentes), por duas vezes, todos do Código Penal Militar. 2. Alegações da defesa: a) nulidade do acórdão condenatório com relação à caracterização do crime de extorsão; e b) direito de recorrer em liberdade. 3. Com relação à alegação de nulidade do acórdão condenatório, verifica-se que a matéria não foi apreciada pelo STJ. Uma vez que os recorrentes não comprovoram situação de manifesto constrangimento ilegal, a análise da matéria pelo Supremo Tribunal Federal implicaria supressão de instância, o que, salvo hipótese de patente constrangimento ilegal, não é admitido pela jurisprudência desta Corte. Inicialmente, a jurisprudência do STF orienta-se no sentido segundo o qual a interposição do recurso especial e/ou recurso extraordinário não impede, em princípio, a prisão do condenado. Precedentes citados: HC nº 77.128/SP, 2ª Turma, por maioria, Rel. Min. Nelson Jobim, DJ 17.11.2000; HC nº 81.685/SP, 1ª Turma, unânime, Rel. Min. Néri da Silveira, DJ 17.5.2002; e HC nº 80.939/MG, 1ª Turma, unânime, Rel. Min. Ellen Gracie, DJ 13.9.2002. 5. Desde o início do julgamento da RCL nº 2.391/PR, Rel. Min. Marco Aurélio, o Plenário deste Tribunal tem discutido amplamente a possibilidade de reconhecimento do direito de recorrer em liberdade. Embora não tenha sido concluído o julgamento da referida reclamação, o entendimento que estava a se firmar, inclusive com o meu voto, pressupunha que eventual custódia cautelar, após a sentença condenatória e sem trânsito em julgado, somente poderia ser implementada se devidamente fundamentada, nos termos do art. 312 do Código de Processo Penal. 6. Na espécie, os recorrentes foram absolvidos em primeira instância pelo Conselho Especial de Justiça, permanecendo em liberdade durante toda a instrução criminal, assim como até o julgamento da apelação. No julgamento da Apelação Criminal interposta pelo Parquet Estadual, a Segunda Turma Criminal do Tribunal de Justiça de Mato Grosso do Sul não especificou quaisquer elementos suficientes para autorizar a constrição provisória da liberdade, nos termos do art. 312 do CPP e 93, IX, da CF. Ademais, um fator importante é o de que apenas a defesa interpôs Recurso Especial. 7. Considerado o princípio constitucional da não-culpabilidade (CF, art. 5º, LVII) e dada a ausência de indicação de elementos concretos para basear a prisão preventiva, não é possível interpretar o simples fato da condenação em sede de apelação como fundamento idôneo para, por si só, demandar a custódia cautelar do paciente antes do trânsito em julgado. 8. Recurso conhecido em parte, e, nessa parte, provido, para que seja assegurado aos recorrentes o direito de recorrer do acórdão condenatório em liberdade até o trânsito definitivo da condenação criminal.</b> </p>
